H-1B Lottery 2027: New Wage Rules & $100K Fee Update

2 min read · Updated Oct 11, 2026

Reviewed on 11 October 2026. H-1B planning requires separate checks for the registration season, employer petition, wage classification and any applicable entry restrictions. A registration selection does not by itself grant a visa or permission to work.

What the September 2026 document says

Proclamation 11069 in the Federal Register extends the restriction on entry of certain H-1B workers until September 2027. It describes a $100,000 payment for covered petitions and provides a national-interest exception. Its petition restriction addresses workers outside the United States; do not treat this as a universal charge for every existing H-1B worker.

The document also describes weighted selection as having operated for the FY 2027 cap season. The fiscal-year label and the calendar-year registration date are different. Check the next USCIS announcement before treating any future registration window as confirmed.

Confirm your employer’s filing plan

Ask the employer whether the position and petition are cap-subject or cap-exempt, whether you will seek consular processing or another eligible procedure, and who is responsible for each filing step. Request a written explanation of the proposed job duties, work location, wage classification and intended start date.

Keep your passport details, qualifications and work-history records consistent across the employer’s documents. Report any change in your location or immigration status before submission. Avoid relying on an old social-media post to decide whether a payment, exception or court order applies to your case.

Check current instructions before paying

Read the current USCIS H-1B guidance with the employer or its qualified immigration adviser. A proclamation is an important source, but implementation instructions and litigation can change the practical position. This article does not establish the latest outcome of every court challenge.

Do not pay an agent for a guaranteed selection or guaranteed visa. Ask for an itemised explanation, the official payment destination and evidence that any claimed exemption applies. Keep copies of the employer’s instructions and receipts.

Prepare a realistic timeline

Organise academic records and employment references early, ask when the employer will review them, and keep a backup plan if selection or approval does not occur. Confirm travel and work authorisation separately before booking a journey or leaving an existing job.
